1. ESTIMATE VALIDITY: This estimate is valid for thirty (30)
calendar days from the date issued. Material pricing and product availability are subject to
change without notice due to supplier costs or market conditions.
2. SCOPE OF WORK: This estimate includes only the labor,
materials, and services specifically listed herein. Any work requested by the Owner that is not
expressly included in this estimate or any approved change order shall be considered additional
work and billed on a Time and Materials basis at $85.00 per man-hour, plus the cost of all
materials, equipment, subcontractors, permits, disposal fees, and applicable taxes.
3. CHANGE ORDERS: Any changes or additions to the scope of work
must be approved by both parties before the work is performed whenever reasonably possible.
Additional work may increase the contract price and extend the project completion date.
4. DEPOSITS & PAYMENTS: A deposit may be required before
materials are ordered or work begins. Remaining payments are due according to the agreed payment
schedule. Overdue balances may accrue interest at the maximum rate permitted by law. Customer is
responsible for all reasonable costs of collection, including attorney fees and court costs
where permitted by law.
5. CONCEALED CONDITIONS: This estimate is based on visible site
conditions. Hidden or unforeseen conditions, including but not limited to rot, mold, water
damage, structural deficiencies, underground utilities, hazardous materials, or code violations,
are not included in this estimate and will require additional charges.
6. PERMITS & INSPECTIONS: Unless specifically stated
otherwise, permit fees, engineering, architectural services, surveys, inspections, and testing
are not included in this estimate.
7. CUSTOMER RESPONSIBILITIES: Customer shall provide safe and
reasonable access to the work area, including access to utilities as necessary, and shall remove
personal property from the work area before work begins. Delays caused by customer may result in
additional charges.
8. DELAYS BEYOND OUR CONTROL: Y&S Enterprises LLC shall not
be responsible for delays in the commencement or completion of work caused by circumstances
beyond its reasonable control. Such circumstances include severe weather, Acts of God, natural
disasters, fires, floods, earthquakes, labor shortages, supplier delays, material shortages,
utility outages, government actions, permit delays, strikes, or civil disturbances. Project
completion dates shall be extended accordingly.
9. MATERIALS: Product colors, textures, dimensions, and finishes
may vary due to manufacturer tolerances. Comparable materials may be substituted if specified
products become unavailable.
10. WARRANTY: Y&S Enterprises LLC warrants its workmanship for one (1) year
from the date of substantial completion unless otherwise stated in writing. Manufacturer
warranties apply only to products they manufacture. Warranty does not cover normal wear, abuse,
neglect, or alterations.
11. LIMITATION OF LIABILITY: To the fullest extent permitted by
law, Y&S Enterprises LLC shall not be liable for incidental, indirect, special,
consequential, or punitive damages, including loss of use, loss of profits, or business
interruption. Total liability shall not exceed the amount paid to Y&S Enterprises LLC for
the specific work giving rise to claim.
12. SITE SAFETY: Customer is responsible for keeping children,
pets, and unauthorized persons away from the work area. Y&S Enterprises LLC shall not be
responsible for injuries resulting from unauthorized access to active construction areas.
13. EXISTING CONDITIONS: Y&S Enterprises LLC is not
responsible for damage or additional costs resulting from pre-existing structural defects,
hidden damage, settling, drainage issues, code deficiencies, or previous workmanship discovered
during construction.
14. CLEANUP: Construction debris generated by Y&S Enterprises
LLC will be removed upon completion unless otherwise stated. Detailed cleaning services are not
included unless specifically listed.
15. RIGHT TO SUSPEND WORK: Y&S Enterprises LLC reserves the
right to suspend work for non-payment, unsafe working conditions, lack of site access, or
material shortages until issue is corrected.
16. MECHANIC'S LIEN RIGHTS: Failure to make payments as agreed
may result in Y&S Enterprises LLC exercising all rights available under applicable state
law, including filing a construction or mechanic's lien against property.
17. DISPUTE RESOLUTION: Parties agree to attempt to resolve
disputes through good-faith negotiation before pursuing legal action unless otherwise required
by applicable law.
18. ENTIRE AGREEMENT: This estimate, together with any approved
written change orders, constitutes entire agreement between parties. No verbal statements shall
modify these terms unless confirmed in writing.
19. GOVERNING LAW: This agreement shall be governed by the laws of the state in
which work is performed.
ACCEPTANCE OF TERMS & QUOTE: By signing below, the customer acknowledges that they have read, understood, and agreed to all terms, conditions, and line-item specifications listed in this 2-page quotation.
